Agreement Between Henan Tourism Group Co. Ltd – Customer

 

1. Terms in this Agreement

Henan Tourism Group Co. Ltd, abbreviated as HTC: The agent in China for the travel arrangements booked through this website.

CUSTOMER: a customer is any person or registered organisation that enters into an agreement with HTC.

 

AGREEMENT: agreement in this context means a contract that has been entered into between a customer and HTC with the purpose of booking a travel arrangement between CUSTOMER and HTC.

 

2. About the Agreement

2.1. Agreement. This agreement is in place as soon as a booking form with details of customers and form of payment has been given to HTC by email or this website. Upon sending the booking form CUSTOMER agrees to be bound by these booking conditions.
2.2. Unconditionality. No agent, staff, representative or customer of HTC has any right to alter or vary or waive any of these conditions. After booking the agreement can only be cancelled in accordance with article 4 of these booking conditions.
2.3. Personal Circumstances. CUSTOMER has the obligation to inform HTC about all relevant personal circumstances of all persons booked (e.g. age, handicap, chronical illness etc) that could influence the operation of the tour.

3. The tour offer
The tour offer consists solely of the items that are mentioned in the program and exclude any other item that is not explicitly mentioned in the program. The tour offer can be revoked or altered without any liability if it is caused by Force Majeure.

4. Payment and acceptance of Booking
The booking will be accepted upon receipt of a non-refundable deposit of circa 10% of the tour price, by any one of the payment forms acceptable to HTC. HTC will there upon send an e-mail stating that the booking is accepted and the tour reserved. The balance of the tour price is payable in full upon arrival in the country where the tour takes place, in a manner previously established by e-mail between CUSTOMER and HTC. If the balance of the tour price is not paid upon arrival, HTC reserves the right to cancel the booking, and the costs incurred shall be according to article 5.

5. Cancellation, change or substitution by CUSTOMER
5.1. Cancellation. Any notification of cancellation must be by e-mail and this notification will be confirmed by HTC. In the event of cancellation the initial down payment made online will be charged as cancellation fee.
5.2. Change by customer. If a customer wishes to change a booking from one tour to another, CUSTOMER must cancel the first tour and book a new one, whereby the previous article applies.

6. Cancellation by HTC
HTC reserves the right to cancel any tour due to circumstances beyond the its control, such as (but not limited to) a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike. In the event of a tour being fully cancelled for whatever reason by HTC, CUSTOMER may choose a full refund of all moneies paid, or alternatively any other tour that HTC is in a position to offer. No further liability by HTC to CUSTOMER with regard to the cancellation will arise.

7. Unused Services
In the event of a customer failing to join a tour, joining after the start of the tour, or leaving prior to completion, no refunds or liability will be accepted by HTC. The total tour price will remain due if customer fails to join a booked tour, joins after the start of the tour or leaves prior to completion.

8. Information
The information on the websites, in brochures, circulars, leaflets and other advertisements issued by HTC is given in good faith, and unless specifically stated shall not form part of any contract between CUSTOMER and HTC.

9. Changes of itinerary
HTC does not accept any liability arising from changes of itineraries, or any other matter relating to a tour, circumstances beyond the its control (as mentioned in Article 6). Any expenses incurred by the HTC as a result of these changes will have to be paid on the spot by CUSTOMER. Failure to do so will result in the termination of the tour there and then, without any further liability on the part of HTC.

10. Travel documents
All customers must be in possession of a valid passport, together with any necessary visas or required vaccinations, and CUSTOMER accepts full responsibility for obtaining same. HTC gives necessary help that are requested by the Embassy. Should a customer be refused entrance to China due to incorrect or incomplete documentation, HTC will not be held liable for any costs of such delays or repatriation costs for CUSTOMER.

11. Authority on Tour
CUSTOMER accepts at all times the authority and decision-making of the tour leader or in his absence, the representatives of HTC with regards to all matters likely to endanger the safety and wellbeing of the tour.

12. Unsuitability
Should a customer, in the sole opinion of HTC or its duly authorised representative, be considered unsuitable for the tour, due to being in contravention of any customs or laws of the country, or by reason of causing inconvenience or annoyance to other passengers, then HTC or its local representative may decline to carry such customer any further. In such circumstances HTC will not be liable to make any refund to CUSTOMER, and no other liability by HTC to CUSTOMER will arise.

13. Limitation of Liability
Customer’s bookings are accepted on the understanding by CUSTOMER that certain risks exist, which are an inherent part of traveling in countries with an infrastructure and development level that does not match that of the European Community or the USA, and that customers undertake all tours and associated expeditions entirely at their own risk. While HTC takes every precaution to ensure the safety of customers, no responsibility can be accepted for any death, injury or loss which might occur to such customers, sustained from any cause whatsoever. CUSTOMER and his/her dependants, heirs, executors, administrators or assigns, hereby indemnify and hold blameless HTC, its members, employees, representatives and local agents from any claims of whatsoever nature and from any liability for delay, loss, damage, injury, illness, or death, arising from any cause whatsoever out of events related to or occurring during a tour.

14. Travel insurance
It is compulsory for all customers to effect appropriate travel- and cancellation insurance before commencing a tour. This insurance, which must be valid for the full duration of the tour, must cover cancellation, curtailment, medical costs, emergency travel, and personal accidents. These insurances can be taken out at any insurance agency, but not with HTC. Customers must hand over copies of the insurance policies to HTC on the first day of the start of the tour. Failure to do so can result in the cancellation of the tour.

16. Claims and Complaints
Complaint procedure. Any complaint that CUSTOMER has against HTC, must firstly be taken up with the tourleader and/or the local representative of HTC, in order to give the tour leader and/or the local representative an opportunity to remedy the problem. A written statement from the tour leader and/or the local representative of HTC that the complaint has arisen and has not been dealt with to the satisfaction of CUSTOMER, has to be drawn up if CUSTOMER wishes to pursue any further complaint after the tour. This complaint must be lodged in writing to HTC within 30 days from the end of the tour. If these procedures are not followed, then HTC will not be held liable.


Payment infomation

 

When booking a tour, you are obliged to make a 10% down payment of the total amount to HTC’s bank account hereunder, finalizing your booking.

HTC will send you an email confirming the arrival of the down payment and sending confirmation of the tour.

The rest of the amount needs to be paid upon arrival to HTC or its local representatives. Details of the rest payment will be given in the confirmation.
